The Court of International Trade issued the first major ruling, holding that none of the tariffs fit inside the narrow IEEPA emergency window. Bryan: 'Congress has the power to lay and collect taxes and duties. And this is a duty. A tariff is a duty. It's a tax on imported goods.' The CIT read the statute correctly.
