Case Overview

A coalition of states led by Washington sued the U.S. Department of Housing and Urban Development over HUD's late-2025 overhaul of the Continuum of Care (CoC) program, the main federal homelessness-assistance grant stream. The states challenged HUD's November 2025 and December 2025 funding notices under the Administrative Procedure Act, arguing HUD rewrote the funding rules without the required notice-and-comment rulemaking and steered money away from permanent supportive housing. Filed in the District of Rhode Island before Judge Mary S. McElroy on November 25, 2025, it is the states' half of a two-front fight: advocacy nonprofits led by the National Alliance to End Homelessness brought a parallel 2025 suit (1:25-cv-00636), and both coalitions sued again in 2026 over HUD's replacement notice (1:26-cv-00436 and 1:26-cv-00439).
