Case Overview

Citizens for Responsibility and Ethics in Washington, joined by hospitality-industry competitors, sued President Trump under both Emoluments Clauses, arguing his hotels and restaurants took payments from foreign and domestic governments. The district court dismissed the suit, but in September 2019 the Second Circuit revived it, finding the competitor plaintiffs had standing. On January 25, 2021, after Trump left office, the Supreme Court granted review, vacated the lower rulings, and sent the case back with instructions to dismiss it as moot.
