Case Overview
The EEOC, investigating alleged antisemitism at the University of Pennsylvania, subpoenaed the university for the names and personal contact information of members of Jewish organizations on campus and of Jewish studies faculty. The dispute was whether the federal government could compel a university to identify people by religious affiliation or national origin. Judge Gerald J. Pappert of the Eastern District of Pennsylvania ruled in March 2026 that Penn had to comply, and Penn appealed to the Third Circuit.

Resolved by agreement on 2026-07-23, without an appellate ruling. In a Resolution Agreement filed that day, the EEOC warranted that it will not take any further measures to enforce the subpoena seeking the identification and personal contact information of Penn employees, will not enforce the district court order regarding that subpoena, and will not otherwise seek that material during the pendency of its administrative investigation. The parties agreed to file a stipulation stating that the agreement moots the appeal, each side bearing its own costs and fees. Penn agreed NOT to seek vacatur of the district court opinion, so that opinion stands.
