Everson v. Board of Education
SCOTUS · Decided Decided
Case Overview
Incorporated the Establishment Clause against the states while upholding New Jersey's reimbursement of bus fares for students attending parochial schools as a neutral public benefit. Justice Black's opinion described a wall of separation between church and State that must be kept high and impregnable, then found the program did not breach it; the starting point of modern Establishment Clause doctrine on both the separation and school-aid sides.
