Case Overview

Ludecke v. Watkins held that the Alien Enemy Act of 1798 authorized the President to deport German nationals during World War II without judicial review. The Court ruled that the executive's wartime power to remove enemy aliens was a political question not subject to habeas corpus once war had been declared and while it remained unresolved.
