Case Overview

Perpich v. Department of Defense held unanimously that Congress may authorize the President to order National Guard units to active duty for training outside the United States without the consent of the Governor of the state from which the units are drawn. The Court rejected the Governor's dual-enlistment theory and found the Montgomery Amendment constitutional under the Army Clause.
