Case Overview

An Administrative Procedure Act and First Amendment challenge by six Eugene, Oregon activists who regularly protest federal immigration enforcement at the Wayne L. Morse federal building. They sued the General Services Administration over its decision to erect a tall security fence around the building that walls off much of the adjacent Free Speech Plaza, the traditional site for demonstrations. The plaintiffs argued the fence project is final agency action that was undertaken without required process and that it physically blocks protected First Amendment activity. Filed June 4, 2026 before Judge Mustafa T. Kasubhai, the case moved quickly: the court granted a preliminary injunction on June 22, 2026 (clarified June 26). The GSA appealed to the Ninth Circuit (No. 26-4023) and sought a stay pending appeal, but it withdrew the stay request and then voluntarily dismissed the appeal, with the mandate issuing July 28, 2026. At a July 2 status conference the district court found the GSA in compliance with the injunction. The case now proceeds on the merits, with the GSA's answer due August 10, 2026 and the administrative record to be lodged.
