Case Overview
Arising from the Kent State shootings, it unanimously held the Eleventh Amendment does not bar damages suits against state officials sued personally, and that executive officers receive only a qualified immunity that varies with the scope of discretion and the circumstances, not absolute immunity. Its good-faith formulation governed Section 1983 suits until Harlow v. Fitzgerald made the test purely objective.
