This is the intervening states' appeal, consolidated with No. 26-1774, in the multistate challenge to Executive Order 14399, "Ensuring Citizenship Verification and Integrity in Federal Elections" (91 Fed. Reg. 17125, Mar. 31, 2026). After the district court (D. Mass., Judge Indira Talwani) granted the plaintiff states summary judgment and enjoined the EO's federal-election provisions for the November 2026 elections, a group of intervening states (led by Alabama) appealed alongside the federal defendants and moved to stay the injunction pending appeal. On July 25, 2026, the First Circuit denied the stay in a single order covering both appeals, leaving the injunction in force; Judge Dunlap concurred in part and dissented in part.
