Case Overview
The Solicitor General asked the Supreme Court to stay the permanent injunction against Sections 2 and 3 of Executive Order 14399, 'Ensuring Citizenship Verification and Integrity in Federal Elections,' with respect to the November 3, 2026 federal election, and requested an immediate administrative stay. The application follows the First Circuit's July 25, 2026 order denying a stay pending appeal in No. 26-1774. The government argues the suit is premature: Section 2(a) directs DHS to compile and transmit State Citizenship Lists but does not require States to use them; Section 3 directs USPS only to begin a proposed rulemaking on ballot mail, and no final rule has issued.
