Strengthening Customs Enforcement

Establishes that customs enforcement must be reformed to prevent importers from evading duties and compliance with federal laws, addressing systemic inefficiencies in the current system.

Directs Secretary of Homeland Security to revise regulations within 180 days requiring importers of record to maintain minimum tangible assets, enhanced bonding levels, and good standing status based on compliance history.

Directs establishment of heightened import disclosure and certification requirements including compliance verification, foreign tax and business identifiers, supply chain information, and enforcement of criminal and civil penalties for noncompliance.

Directs Secretary to maximize enforcement through liquidated damages claims against bonds, restricted in-bond utilization, increased audits, and maximum penalties for non-compliant brokers.

Directs agencies to expedite the disposal process for seized and forfeited merchandise to improve efficiency and reduce storage costs.

Directs establishment of enhanced transparency measures and requirements for regular reporting on enforcement actions and compliance metrics.

Directs consultation with relevant executive departments and agencies in implementing customs enforcement reforms.

Directs development of legislative recommendations to further strengthen customs enforcement authority and procedures.

Requires annual reporting to the President on customs enforcement implementation, violations, and penalty assessments.

Defines key terms including Secretary, Customs and Border Protection, appropriate committees, and good standing for importers of record.

Standard severability clause: if a court strikes any provision, the rest of the order stands.
