Section by Section
What each section does, and how they differ.
The framing section. Casts citizenship as an inheritance that should not be obtained through what the order calls calculated exploitation of the immigration system by birth tourism.
Delegates the President's Immigration and Nationality Act authority to the Secretaries of State and Homeland Security to carry out the order.
Defines birth tourism as entering or facilitating entry on a nonimmigrant visa for the purpose of giving birth on U.S. soil.
The operative section. Authorizes State and DHS to deny visas, revoke travel authorization, permanently bar entry, or remove aliens engaged in birth tourism.
Lets the Secretaries grant case-by-case exemptions on humanitarian grounds or in the national interest.
Standard closing boilerplate: severability, implementation subject to law and appropriations, and no enforceable rights; DHS bears publication costs.
