In 2025 the Trump administration federalized National Guard troops, and in Los Angeles active-duty Marines, and deployed them to several cities alongside immigration enforcement. The legal fight is distinct from the enforcement itself: it turns on the President's authority to put military forces into domestic operations, under 10 U.S.C. 12406, 32 U.S.C. 502(f), the Posse Comitatus Act, and the Tenth Amendment. The courts have not agreed: Portland struck the deployment down after trial, Chicago's block held through a Supreme Court stay denial, Los Angeles was ruled unlawful at the district court, and Washington, D.C.'s injunction was stayed on appeal.
