In late September 2025, President Trump announced the deployment of about 200 federalized Oregon National Guard troops to protect the ICE facility in Portland's South Waterfront neighborhood amid protests. Oregon and the City of Portland sued. This page tracks the military-deployment fight, which turns on 10 U.S.C. 12406 and the Tenth Amendment. It produced the first trial in the country on a president's authority to deploy a state's Guard, and the plaintiffs won.

Oregon and Portland sued to block the federalization and deployment of the Oregon National Guard. Judge Karin Immergut issued a TRO on October 4, 2025, and after a three-day bench trial, entered a permanent injunction on November 7, 2025, finding the deployment violated 10 U.S.C. 12406 and the Tenth Amendment and that the protests had been largely peaceful. The government's Ninth Circuit appeals (Nos. 25-6268, 25-7194) were dismissed after the troops demobilized.
