What Is the REAL ID Act of 2005?

Before 2005, immigrants facing removal could challenge the government in two places: habeas corpus petitions in district court, or petitions for review in the circuit courts. Congress passed the REAL ID Act in 2005 to close the district-court path and channel all removal-related claims into one proceeding before the circuit courts. The Act's centerpiece is 8 U.S.C. § 1252(b)(9), often called the **zipper clause**, which strips federal district courts of jurisdiction over any challenge, whether constitutional or statutory, that arises from an action taken to remove someone from the United States. The only path for judicial review is a petition for review of a **final removal order** filed directly in a circuit court. The zipper clause prevents what Congress saw as piecemeal litigation, where the same removal could be challenged in multiple forums. Courts interpret "arising from any action taken ... to remove" expansively: if a claim challenges the government's basis for removal, it must go through the petition-for-review process, even if framed as a First Amendment or due process claim. Collateral challenges truly independent of removal itself (like conditions of confinement or access to bail hearings) can still proceed via habeas corpus, but claims attacking the removability determination or the decision to initiate removal proceedings are barred from district court.
