Case Overview

The United States brought facial challenges to provisions of New York Senate Bill S9005C (the "Budget Act," signed by Gov. Hochul on May 27, 2026): New York Civil Rights Law sections 101 (the "Face Covering Act") and 102 (the "Identification Act") and New York Executive Law 170-k (the "Termination Act"). On August 3, 2026 Judge Mae A. D'Agostino granted a preliminary injunction in part, enjoining New York from enforcing Civil Rights Law 101 and 102 against the federal government, and denied it as to Executive Law 170-k.
