Ensuring Lawful Governance and Implementing the President's "Department of Government Efficiency" Deregulatory Initiative

Constitutional governance requires that President and Attorney General provide authoritative legal interpretations controlling executive branch action, and agencies must enforce only laws properly understood and within Federal authority.

Agency heads shall review all regulations within 60 days to identify unconstitutional regulations, unlawful delegations, regulations exceeding statutory authority, regulations of social or economic significance without clear statutory authorization, regulations imposing disproportionate costs, regulations harming national interest by impeding innovation or infrastructure, and regulations burdening small business. Agencies shall prioritize review of significant regulatory actions and provide reports to Office of Information and Regulatory Affairs.

Agencies shall de-prioritize enforcement of regulations based on anything other than best statutory reading and shall de-prioritize enforcement of regulations exceeding Federal powers. Agency heads shall terminate enforcement proceedings for regulations not compliant with Constitution, laws, or Administration policy.

Agencies shall follow Executive Order 12866 review processes and consult DOGE Team Leads and OIRA Administrator on potential new regulations, evaluating proposed regulations against constitutional and statutory authority factors.

Director of OMB shall issue implementation guidance as appropriate.

Establishes definitions of Agency and Agency head.

Order does not apply to certain categories of agency action as determined by Presidential discretion.

If any provision is held invalid, remainder of order and its other applications are unaffected.

Standard boilerplate: preserves existing agency authority, conditions the order on appropriations, and creates no enforceable private rights.
