Sec. 1 Background

Recalls Executive Order 14323 imposing 40% tariffs on Brazilian goods and notes ongoing negotiations to address national security concerns.

Sec. 2 Tariff Modifications

Modifies the Harmonized Tariff Schedule to adjust duties on Brazilian agricultural imports effective November 13, 2025, based on progress in bilateral negotiations.

Sec. 3 Implementation

Directs State Department to monitor the emergency declared in EO 14323 and coordinate with Treasury, Commerce, Homeland Security, and USTR on implementation.

Sec. 4 Severability

Standard severability clause: if a court strikes any provision, the rest of the order stands.

Sec. 5 General Provisions

Standard boilerplate: preserves existing agency authority, conditions the order on appropriations, and creates no enforceable private rights.
